Beyond the Classroom Video Series: Participation–The Key to Growth

Adam Crnkovich is currently a Project Manager at the Ray Martin Company and a previous member of the University of Nebraska- Lincoln student chapter. As a student, Adam really enjoyed participating in MCAA’s Student Chapter Competition as it gave him incredible exposure to technical aspects that contractors work on, as well as played a huge role in his understanding of the industry as a whole.

Additionally, during his time in his student chapter, Adam actively attended MCAA GreatFutures Forums and MCAA Annual Conventions which he says not only helped him continue to learn about the industry and network, but ultimately helped him grow further into his field and as a person. Adam shared participating in these opportunities “gave me a lot more experience that not only understand if this is something I wanted to pursue, but also how I could be better in the industry and grow as a person and career in general.

Adam loves that the mechanical contracting industry is not only about building things, but building people and relationships, something he has personally benefited from.

Resource Highlight: MCAA BIM & Prefabrication Resources

Each week, MCAA will highlight one or more of the educational resources that are free to MCAA members as a benefit of membership. This week, we focus on two SmartMarket reports developed in partnership Dodge Data & Analytics. The reports on BIM and prefabrication will help contractors understand the benefits, challenges and opportunities presented by these technologies.

In his remarks at MCAA’s Virtual Education Conference, MCAA President Armand Kilijian identified fabrication of duct, pipe, and building systems as one example of a technology that, once implemented in a company’s culture, can reap yearly benefits. These reports provide the legwork needed to get started with or expand use of both BIM and prefabrication.

MCAA and Leading Experts Discuss What Recent Multiemployer Pension Reforms Will Mean for Your Company

What do the multiemployer pension reforms in the Butch Lewis Emergency Pension Plan Relief Act of 2021 (signed into law by President Biden in the American Rescue Plan Act of 2021 on March 11, 2021) mean for your company? MCAA’s John McNerney is joined by leading industry experts Earl Pomeroy of Alston & Bird and Josh Shapiro of The Groom Law Group to lay out the details of the law, the questions remaining to be answered in regulations issued by the Pension Benefit Guaranty Corporation in the 1,200 days from enactment, and what it will mean for your plans and the industry overall. Mr. Shapiro and Mr. Pomeroy will also speak about remaining reform items to be addressed in upcoming enactment of Composite Plans and perhaps also new and improved Variable Benefit plan options for trustees to consider.

About the Presenters

Former Congressman Earl Pomeroy, who served in Congress for 18 years, and as a member of the prestigious House Ways and Means Committee, was the lead sponsor of the Pomeroy-Tiberi pension reform proposal as early as 2010. He is currently consulting with MCAA on pension reform issues.

Josh Shapiro is a leading actuarial expert on multiemployer pension issues in Washington, D.C., having served as the research and policy director at the National Coordinating Committee for Multiemployer Plans, and for the past eight years as a pension/actuarial advisor at The Groom Law Group in Washington, D.C. For many years, Mr. Shapiro and Groom Law Group have served as advisors to MCAA on pension and other employee benefits policy issues.

John McNerney is MCAA’s General Counsel. He also serves as executive director of government and labor relations at MCAA, collaborating with other specialty construction employer groups and the United Association to advance legislative and policy positions in MCAA members’ best interests.

2021 WiMI Conference Update

We have regrettably made the decision to reschedule the 2021 WiMI Conference, originally planned for June 21-23, 2021 at the JW Marriott Austin, to June 2022. We tried our best to make WiMI2021 happen, but we were just not powerful enough to fight a pandemic. Even though the state of Texas may be open, there are still some very strict gathering restrictions in place in Austin, TX and too much uncertainly remains as to what it will be like in June. Safety remains our highest priority. So mark your calendars for June 6–8, 2022 at the JW Marriott Austin when, hopefully, we will be able to meet, learn, connect, catch up, gather, kick up our heels and hug for real as we gather together as the amazing women of MCAA/MSCA.

Webinar to Focus on American Rescue Plan Act of 2021 Provisions for Multiemployer Pension Plans

Horizon Actuarial Services, LLC, and the Groom Law Group will be co-sponsoring a complimentary webinar on the American Rescue Plan Act of 2021 provisions for multiemployer pension plans. The webinar, which will address how recent law changes will impact multiemployer pension plans in general, will take place Tuesday, March 23 at 12:00PM EDT. A summary of the changes can also be found on Horizon’s website.

Tuesday, March 23, 2021 | 12:00 p.m. EDT

On March 11, 2021, President Biden signed a significant COVID-19 relief package – the American Rescue Plan Act of 2021 – into law. Included in this legislation are several provisions that provide temporary funding relief to multiemployer pension plans, as well as a significant amount of special financial assistance that is available to seriously underfunded plans. The temporary funding relief provisions are broadly available to multiemployer plans, and they allow additional time for plan sponsors to address the investment and other losses incurred in recent years. Significantly underfunded plans can demonstrate eligibility for the special financial assistance based on their funded position in 2020, 2021, or 2022. Initial applications for assistance are due by the end of 2025. Financial assistance will be paid to eligible plans as lump sums that do not need to be repaid, and is intended to keep plans solvent through 2051.

The panelists on this webinar will discuss the development and passage of the legislation, the key funding relief and financial assistance provisions, and the various aspects of the legislation that are not fully clear and may be open to multiple interpretations.

Important Note: You will receive an email from the Groom Law Group on the morning of March 23rd with the link to access the webinar.

What to Look for in OSHA’s COVID-19 NEP

There may be some good news regarding OSHA’s new National Emphasis Program (NEP) on enforcing worker protections against COVID-19. Despite the Office of the Inspector General’s February 2021 recommendation that OSHA promulgate an Emergency Temporary Standard (ETS) on COVID-19, it appears that the agency will postpone development of an ETS in favor of the NEP. Here’s what you should know about the NEP to protect your company from OSHA citations.

NEP INSPECTION TYPES

Unprogrammed Inspections

  • OSHA’s primary emphasis will be on unprogrammed inspections triggered by

1st Fatalities;

2nd Complaints; and/or

3rd Referrals.

Programmed Inspections

  • OSHA’s secondary emphasis will be on programmed inspections.
  • There are two tiers of “high risk” employers being targeted by OSHA, Primary Target Industries and Secondary Target Industries.
  • The agency’s emphasis concerning programmed inspections first will be on Primary Target Industries, such as dental care, hospitals, health care, nursing homes, ambulance services, etc.
  • Construction falls into the Secondary Target Industries category along with agriculture, manufacturing, and certain types of transportation.

Programmed Inspections in Construction

Programmed inspection locations will be selected randomly from a list of construction worksites (F.W. Dodge Reports). The emphasis will be on larger projects that are 30% to 60% complete.

What Compliance Officers Will be Looking to Find

OSHA compliance officers will be looking for obvious signs of non-compliance with the agency’s February 2021 COVID-19 Guidance to Prevent the Spread in the Workplace (MCAA Summary). MCAA urges you to pay close attention to your:

  • Prevention Programs;
  • Return to Work Criteria;
  • Social Distancing Measures;
  • Engineering Controls;
  • Face Coverings and PPE; and
  • Sanitization, Cleaning, and Disinfecting Practices.

Probable Citations

  • General Duty Clause
  • Respiratory Protection Standard
  • Personal Protective Equipment Standards
