Beyond the Classroom Video Series: Following Your Interests to First-Hand Experience

Colten Lovejoy’s interest in the mechanical construction industry may have stemmed from watching his father work in the industry for 25 years, but he was quick to create his own experiences. Colten knew he wanted to immediately start working in the field. As a student, he interned with MMC Contractors in Kansas City, MO for two summers as a pre-apprentice alongside journeymen, laborers, and foremen and really enjoyed seeing and understanding how and why complicated systems work the way they do, first-hand.

Colten graduated from Pittsburgh State University in May and is now a full-time employee at MMC Contractors. He credits not only his dad, but his Pittsburg State University Faculty Advisor, Shannon Nicklaus for helping him continue his education and career in the industry. Through Colten’s involvement in his MCAA student chapter, he has gained a life-long mentor, as well as a network of industry peers. Even if later in life he has a question or is looking to problem solve, he knows he can call anyone he has met through this program to work through it together.

SitelogIQ Speeds Up Processes Using XOi Technologies

SitelogIQ, a full-service facilities solution provider in California, has proof that seeing is believing—and they are speeding up their quote approval process as a result. “We’re capturing XOi content—physical video, pictures—onto quotes, which has expedited how fast those quotes are approved. We seem to get less contested quotes, less questions,” said Jason Saunders, service operations manager for SitelogIQ.

Spotlighting 2020 MSCA Extraordinary Everyday Hero Awardees

MSCA has been honoring our industry’s very own everyday heroes for the past five years at the annual education conference. Our expectations were blown away by just how many heroes we have within our industry – we received nineteen nominations this year! We are so proud of the many peers among us who do extraordinary things every day, simply out of the kindness of their hearts with a passion to make a difference for the better.

Chris LaBarre, McKinstry Co LLC, Seattle, WA

During the current pandemic Chris was working at a newly setup COVID-19 testing facility. From the moment he stepped onto the site he recognized safety concerns for both himself and the client. Chris worked with the client and McKinstry’s safety team to come up with a safe work plan. He never missed a beat while ensuring that the work got done and everyone involved remained safe. Chris’ dedication to safety and his role at McKinstry makes him a valuable asset to both his customers and his employer.

Kyle Seaman, Warwick Mechanical Group, New Port News, VA

A team of Warwick Mechanical Group’s technicians, including Kyle Seaman, traveled to North Carolina during the peak of the COVID-19 pandemic to assist local residents who had been displaced due to Hurricane Florence. The team spent a week doing rebuild and repair work related to their trade but also installed insulation, exterior sheathing, gas piping, flooring, drywall, and framing. They painted, hung cabinets and performed any other repair work needed.

Kyle’s colleague and 2019 Everyday Hero Award Winner Michelle Collier commented, “Kyle is one of our awesome plumbers. He is one of those guys that never complains about the call you send him on, no matter how bad it is or how far away it is. He is always upbeat and always has a positive attitude.”

Tom Skowronski, CT Mechanical, LLC., Addison, IL

Tom is the Piping and Service Manager with CT Mechanical and although he is in a managerial position, he is always willing to perform service calls and remaining hands on whenever the situation warrants.  He takes responsibility for the quality of the work that CT Mechanical performs and uses in time in the field to educate his field staff and demonstrate excellent customer service, safe work practices and quality craftsmanship. He truly puts his heart and soul into his work and works with his field staff as a leader and mentor. When the pandemic first hit, he was extremely focused on making sure all safety precautions were being followed and always led by example.  He was a continual resource for his crew as recommendations were changing by the hour and has continued to stay focused on their safety and wellbeing.

Tom’s colleague, Monica Anderson, shares, “Tom is exceptional for many reasons. He has an unsurpassed work ethic and would never ask or expect anything of his crew that he wouldn’t do himself.” .

Shaun McCann, Atomatic, Arlington Heights, IL

Shaun takes care of one of Atomatic’s best clients, Presbyterian Homes. Due to the COVID-19 pandemic, they have had heightened safety requirements. Shaun has stepped up and gone above and beyond to make them comfortable during this time.

Shaun’s colleague, Steve Stachorek states, “While the work he continues to deliver is exactly what the customer deserves, Presbyterian Homes has gone out of their way to tell me that we are the best contractor they have worked with.”

He serves on Atomatic’s safety committee and is a great leader setting the example when it comes to being safe. His constant dedication to producing high quality work and excelled customer services reflects positively on both him and Atomatic.

MSCA is proud to recognize these heroes in our industry and distinguish them as an MSCA Extraordinary Everyday Hero. We will be spotlighting each of these heroes over the next few months. For a full list of 2020 Extraordinary Everyday Hero Awardees, please click here.

MCAA Virtual Fab Mini Showcased a Modern Approach to Fabrication

Modern Companies presented a virtual tour of their Cedar Rapids, Iowa fabrication operations as part of MCAA’s first Fab Mini presentation.

With the postponement of the 2020 Fabrication Conference to 2021, MCAA offered members a virtual tour of one of the country’s most innovative contractors in Modern Companies. Based in Cedar Rapids, Iowa, Modern has offices and fabrication facilities across two states.

To help track, manage and coordinate fabrication for all of their jobsites and facilities, Modern has integrated MSUITE’s FabPro software to digitize their operations. Their process takes BIM models generated from their VDC department and puts it in the hands of fabrication workers and field personnel.

Not only does it allow for greater amount of information in the hands of those who use it, but it improves communications and labor tracking throughout the company.  In the webinar, Modern’s Fab Shop Manager in Cedar Rapids, Jim Tedrow explains how everyone in the field, the office and the shop get access to better information which almost eliminates the number of calls received a day.  All the status updates, small changes or even full stops are communicated in the software so that everyone working on it knows what the latest change is or can shut down the process entirely.

The webinar, available online to MCAA members is available for viewing through the MCAA Resources Section or clicking the button below.

Questions About the COVID-19 Vaccine? What Can Employers Do Now? Alston & Bird Outline 10 Steps.

A number of important announcements are expected very soon for COVID-19 vaccines. The FDA is currently reviewing requests from Pfizer/BioNTech and Moderna for emergency use authorization (EUA), and the FDA’s Vaccines and Related Biological Products Advisory Committee (VRBPAC) is scheduled to discuss the Pfizer/BioNTech request on December 10 and the Moderna request on December 17. Congress is contemplating potential legislation that could assist states with vaccine distribution and administration. The Advisory Committee on Immunization Practices (ACIP), a group established by the Centers for Disease Control and Prevention (CDC), met on December 1, 2020 and offered recommendations on priority groups for vaccination. Meanwhile, questions abound about how each particular state will distribute and administer the vaccine, including how to handle logistics, cold storage, and staffing.

As we wait for important COVID-19 vaccine information, what proactive steps can businesses take now?

  1. Review and revise your policies as needed. Do you have a policy addressing vaccines for employees? Does the policy require or merely recommend that employees get certain vaccines? Does it address religious or medical objections and accommodation requests? Does your policy only apply to certain enumerated types of vaccines, such as the flu? Update your policies to include the possibility of a COVID-19 vaccine and include a process for employees to request reasonable accommodations for religious or medical reasons. Have you also considered whether COVID-19 vaccines at your business will be presented as mandatory or recommended, and have you thought through employee relations issues that may arise?
  2. Closely track and monitor recommendations on prioritization for vaccines, including for critical infrastructure businesses. At present, there are many unknowns about how the vaccine will be prioritized. On December 1, 2020, the ACIP recommended that “health care personnel” and “residents of long-term care facilities” (as those terms are defined) be included in the first phase for distribution of vaccines. The ACIP has indicated that the next phased group are “essential workers.” These ACIP recommendations will be reviewed by the CDC, and individual states may also develop their own plans. Stay tuned for more developments from the ACIP, CDC, and possibly individual states.
  3. Consider a process and point of contact for employees who have questions about the COVID-19 vaccine. Rather than having a tidal wave of phone calls and emails to Human Resources, consider who is the best person to serve as a central point of contact to receive questions and issue updates to employees. Once that person is identified, inform employees who they should contact with their questions and concerns. Also consider what person should receive and process requests and objections by employees who do not wish to receive the COVID-19 vaccine.
  4. Determine whether information about employees’ COVID-19 vaccination status could be employer work safety information or information created/maintained on behalf of a health plan (and thus covered by HIPAA’s privacy requirements). Consider whether such information is covered by HIPAA obligations (e.g., is it administered through your health plan) or whether HIPAA’s employer exception could possibly apply to information obtained outside of the group health plan.
  5. Ensure compliance with ACA requirements that apply to COVID-19 vaccinations. Federal law generally requires ACA-covered group health plans to cover COVID-19 vaccinations and other qualifying COVID-19 preventive services without participant cost-sharing. The rules for coverage of COVID-19 preventive services are stricter than the rules that apply to other preventive services. For example, vaccinations must be covered by the plan without cost-sharing within 15 business days after recommended by the CDC and regardless of whether the vaccine is administered by an out-of-network provider. In addition to HIPAA privacy requirements that apply, employers need to be familiar with these new ACA preventive care requirements as they consider how to make vaccinations available.
  6. Even if information about employees’ COVID-19 vaccination status is not covered by HIPAA in your particular business, consider how to store such individual information privately and securely. Provide only limited access to such information, such as through role-based access or to a defined group of people on a need-to-know basis in order to perform their job duties. Consider the confidentiality provisions of the ADA as well as record retention obligations, such as possibly under the Occupational Safety and Health Act. Also, consider whether employees will be encouraged to receive the COVID-19 vaccine at specific third-party sites conducted by pharmacies or state public health authorities or anywhere the COVID-19 vaccine is available.
  7. As different vaccine phases of distribution and criteria are announced, how will your business identify those employees who are in certain priority groups identified by the government, such as ≥ 65 years or who have certain medical conditions? Is this an employer responsibility or is it the responsibility of individual employees who wish to receive the COVID-19 vaccine, separate and apart from the employment context? Watch for privacy considerations, including confidentiality obligations under the ADA. Consider the source of such information (e.g., a HIPAA covered health plan, an employer, or the individual employee volunteering that information).
  8. Watch your wording in employee and customer communications. If you seek to have employees receive the COVID-19 vaccine, can you market that your employees (especially in a public-facing business) are “immune” or “protected from COVID-19” or that customers who enter the store are now “at less risk” of contracting COVID-19? Carefully consider the legal ramifications of representations to employees and to the public, especially since information and vaccine data are rapidly evolving. In the meantime, continue to keep posted any signs on your business premises, based on your applicable state law, regarding COVID-19 protective measures and visitors’ assumption of risk.
  9. While we learn more about the availability and distribution of COVID-19 vaccines, don’t abandon current COVID-19 work safety practices at your business, including good hygiene, enhanced cleaning, social distancing (as feasible), and wearing masks (if you require masks at the workplace). A vaccine may be several months away for many individuals (especially those who are not in health care or critical infrastructure or do not meet certain age or health criteria). Even when a COVID-19 vaccine becomes available to your employees in a particular state, some individuals may have personal, medical, or religious objections and plan to decline receiving the vaccine. Plus, published ACIP slides from the December 1, 2020 discussion mention that measures to stop the possible spread, such as masks and social distancing, will still be needed after vaccination.
  10. There are more questions than answers right now, and much is unknown. We all look forward to learning more; for example, once the vaccines are rolled out to the general population, will we see the same level of protection that the vaccine companies have seen in their clinical trials? Will these vaccines give more protection to certain individuals than others? Also, even if an employee is considered fully vaccinated after two doses of the vaccine (the Pfizer/BioNTech and Moderna vaccines both require two doses, spaced weeks apart), how long will the vaccine provide protection? Will there be supply-chain issues that slow down the rollout and delay vaccinations?

Even though COVID-19 vaccine questions abound, there are proactive steps businesses can take now to review, assess, and prepare for upcoming COVID-19 vaccine issues.

Alston & Bird’s Coronavirus Response & Relief Team has assisted many businesses during the ongoing pandemic. They have also established a specific Coronavirus Vaccine Team across multiple practices to handle coronavirus vaccine issues. Please let them know if they can help, and we will continue to work to solve coronavirus issues together.

CDC Issues New Guidance on Quarantine of Individuals Exposed to Persons with COVID-19

December 4, 2020|by Kathleen M. Connelly

Until now, the CDC recommended a 14-day quarantine for individuals who might have had “close contact” with a person who has or is suspected of having COVID-19.[1]  This quarantine was longer than the 10-day recommendation for those who test positive, as the longer quarantine period is based on estimates of the upper boundaries of the viral incubation period. However, in its new guidance issued December 2, 2020, the CDC acknowledged three adverse consequences of the 14-day quarantine:

  • It can impose personal burdens that may affect physical and mental health as well as economic hardship that may reduce compliance.
  • It may pose additional burdens on public health systems and communities, especially when cases are rising and the need to impose quarantines are rapidly rising.
  • It may dissuade recently diagnosed persons from naming contacts and dissuade contacts from responding to contact tracer outreach if they perceive the duration of the quarantine is too onerous.

New Shorter Quarantine Options. In an effort to reduce these burdens and increase community compliance, the CDC has announced the following shorter quarantine alternatives to the 14-day quarantine.

  1. 10-Day Quarantine Option. Under this option, quarantine can end after day 10 without testing and if no symptoms have been reported during this period.
  2. 7-Day Quarantine Option. If diagnostic testing resources are available, quarantine can end after day 7 if i) the test results are negative and ii) no symptoms are reported during this period.  The testing specimen may be collected and tested within 48 hours of the expiration of the 7-day period (or before the planned end of quarantine in the event of testing delays).

Quarantine may only be discontinued under either option if these additional criteria are met:

  • no clinical evidence of COVID-19 was elicited via daily symptom monitoring during the entirety of the quarantine;
  • daily symptom monitoring continues through day 14; and
  • persons are counseled regarding the need to strictly adhere through day 14 to all recommended non-pharmaceutical mitigation strategies, and advised to immediately contact local health officials or their healthcare provider and self-isolate should symptoms develop.

Of course, individuals can continue to quarantine for the longer 14-day period without testing in accordance with the preexisting recommendations, which maximally reduces the risk of post-quarantine transmission.

Persons Who Must Quarantine Together, Such as Households. The CDC further recommends that when housing is shared (e.g., families, incarcerated persons, students), every effort should be made to physically separate the quarantined individual from others through such measures as having the quarantined individual residing alone in a separate closed room with exclusive use of their own bathroom and implementation of other mitigating strategies.  If any co-housed person is diagnosed with COVID-19, all co-housed persons will require evaluation as contacts.

[1] The CDC defines “close contact” as being within 6 feet of an infected person for a cumulative total of 15 minutes or more over a 24-hour period starting from 2 days before illness onset (or, for asymptomatic patients, 2 days prior to test specimen collection) until the time the patient is isolated.

CDC Updates COVID-19 Guidelines on When to Quarantine

The CDC recently updated its guidelines on when to quarantine following exposure to a person who has tested positive for COVID-19. The new guidelines indicate that people who have been in close contact with someone who has COVID-19, excluding people who have had COVID-19 within the past 3 months, should quarantine immediately. It is considered close contact when:

  • You were within 6 feet of someone who has COVID-19 for a total of 15 minutes or more;
  • You provided care at home to someone who is sick with COVID-19;
  • You had direct physical contact with the person (hugged or kissed them);
  • You shared eating or drinking utensils; and/or
  • The person sneezed, coughed, or somehow got respiratory droplets on you.

People who have tested positive for COVID-19 do not need to quarantine or get tested again for up to 3 months as long as they do not develop symptoms again. People who develop symptoms again within 3 months of their first bout of COVID-19 may need to be tested again if there is no other cause identified for their symptoms.

MCAA’s WiMI Mentor/Mentee Program Introduces Jill and Hannah!

Hannah Inman has an infectious energy that she brings to her role as Program Manager with the Mechanical Contractors Association of Metropolitan Washington (MCAMW). Hannah has been with MCAMW for almost 4 years and has been involved with WiMI since the inaugural conference held in Chicago in 2019.

Jill McCall, Executive Vice President of MCA Chicago, has 20 years of association experience and has been in the construction industry for five of those years. Jill was one of the original committee members who kicked off the WiMI initiative back in 2018. She has a strong passion for the program and women’s issues even outside of the construction industry.

The pair bonded instantly, and their communication has only grown throughout the past year. As things slowed down due to the pandemic, they realized how important it was to check in with each other, even just to see how they were doing. With Hannah having a lot on her plate; newly engaged, finishing a degree and establishing new projects at work, the check ins were even more important! They both agree that it is nice to have a person to bounce challenges and new ideas off of, especially during a time where there is so much unknown in the industry as well as the world.

Hannah shared how much she values Jill’s mentorship, especially with not having any prior experience to this industry. “My self-confidence in my role here at MCAMW has improved. I’m learning how to better self-advocate, professionally. Also, my knowledge and communication skills have evolved, creating an advantage in my credibility within my network.”

Hannah recommends this program to all women in the industry – sharing, “as a female, especially a younger female, in a male-dominated industry, there can be challenges that arise which can be hard to navigate or receive appropriate support and/or feedback on. As the industry evolves in today’s world, certain aspects have unfortunately lagged behind others. This program, the support, resources, and its collaborative efforts, have brought aid to its progression, which I have found to be invaluable for both myself and to our association.”

Hannah came into this program with some goals already in place, including enhancing her professional experience and overall development, learning more about the industry, and receiving expert guidance and support. With that, her mentor, Jill, helped her create goals that included checking-in with each other once a month, enhance her efforts with their local WiMI chapter and workforce development, as well as striving to earn her CMP Certification.

Jill signed up for the mentorship role because “mentoring is one of the most powerful ways to help people grow.  It works both ways, too!” She encourages all females in the industry to be role models for new women entering the industry. The frequent check ins have benefited Jill as well, as the two have brainstormed new ideas and ways to improve both their local WiMI chapters and the national chapter.

“It’s the little things,” Jill shares when asked what her most memorable moment of being a woman in the industry has been, “Hearing a speaker adjust the introduction from brothers or gentlemen to brothers and sisters or ladies and gentlemen on the fly.” She has also been excited to see apparel at UA/MCAA events now offered in women’s sizes.

Despite their busy schedules, the pair plans to continue their relationship beyond the initial six-month commitment and value and appreciate the time they can share and learn from each other.

“Jill is a cornucopia of knowledge and wisdom and I am thankful to have been matched with her, as I know our relationship has brought substantial value in my overall professional development,” Hannah concluded.
