1/10/22 Update: OSHA’s ETS on COVID-19

Today is the first day the Occupational Safety & Health Administration (OSHA) can begin enforcement of the planning and record keeping mandates in its Emergency Temporary Standard (ETS) on vaccine mandates.

The Supreme Court of the United States (SCOTUS) heard oral arguments of the appeal on January 7, 2022, but has not reached a determination. Multiple Justices expressed doubt over OSHA’s claim on a “clear” basis for the vaccine ETS. While the Supreme Court could issue a decision at any time, we do anticipate it happening before February 10, 2022, the compliance deadline for testing.

In the meantime, MCAA has provided you with all the tools to help your company comply today.

Compliance Tools

  • MCAA’s Updated Bulletin on OSHA’s COVID-19 ETS – The only changes to the bulletin are the new enforcement dates. This bulletin is a simple reference document for you.
  • The original MCAA Model COVID-19 Mandatory Vaccination Policy – This policy is for companies that require vaccines, but do not allow weekly testing and face covering use as an alternative.
  • The MCAA Model COVID-19 Vaccination, Testing and Face Covering Policy – This policy is for companies that require vaccines, or weekly testing and face covering use as an alternative to vaccines. It can also be easily tailored for use as your Mandatory Vaccination Policy for the companies that require vaccines, but do not allow weekly testing and face covering use as an alternative.

A Simple Record Keeping Tool

Additionally, to support the planning and record keeping deadline, TYFOOM, a member of MCAA’s Manufacturer/Supplier Council (M/SC), created an automated, simple, and easy process to reach all employees on a regular basis with an ETS survey.

Each week, MCAA will highlight one or more of the educational resources that are free to MCAA members as a benefit of membership. This week, we focus on the MCAA/CNA MICROLEARNING SAFETY VIDEO SERIES: Worker Personal Health. This video will teach your workers simple personal health practices that can help reduce the risk of musculoskeletal injuries.

Your workers will learn:

  • How insufficient oxygen throughout the body leads to fatigue and increased risk of injury
  • Why it’s important to have a healthy diet and stay hydrated
  • How both cardio and strength-building exercise can help
  • Why it’s important to stretch and flex muscles several times a day

Together with our partners in safety, CNA, MCAA developed the video, which is part of the MCAA/CNA Microlearning Safety Video Series, a series of easy-to-watch safety videos that are under 3-minutes long.

MCAA and long-time partner in safety CNA bring you the prestigious MCAA/CNA Safety Excellence Awards Program. The annual awards honor MCAA member companies’ successful safety programs and innovative safety initiatives because nothing is more important than the health and safety of our workers. Take a moment to celebrate your company’s successes in 2021 – apply today!

To be eligible to win, a company needs to apply by January 11, 2022, describing:

  • Its safety and health program in 2021 and why it believes it deserves the award, and
  • An innovation that helped it achieve a high degree of safety excellence during the year

Companies will be divided into five categories by number of hours worked, and a winner will be chosen in each category. Each winner will receive national recognition and an award for display. The award will be presented at the Awards of Excellence Breakfast on Wednesday, March 16 in front of more than 1,000 people just before pro football hall of famer Cris Carter delivers the keynote presentation at MCAA’s national convention in San Diego, CA.

New Tool to Track and Report Vaccine and Testing for OSHA’s ETS on COVID-19: 1/3/22

There have been many requests from MCAA members for a simple and easy way to track & report the Emergency Testing Standard (ETS) from OSHA for both the vaccine requirements and weekly testing. 

TYFOOM, a member of MCAA’s Manufacturer/Supplier Council (M/SC), created an automated, simple, and easy process to reach all employees on a regular basis with an ETS survey (examples attached).

Nominations Are Open for MCAA’s Board of Directors – January 14 is the Last Day

The future of MCAA is fundamentally linked to the quality of the individuals who serve on its Board of Directors. MCAA members who would like to be considered for one of four vacancies are encouraged to learn more and complete the application. Applications should be returned no later than January 14, 2022. Candidates and their spokespersons will be scheduled for interviews at the 2022 MCAA Annual Convention. Those who are selected will begin their terms in March 2022.

MCAA Offers Materials to Prepare You for OSHA’s ETS on COVID-19: Prepared 12/22/21

The Occupational Safety & Health Administration (OSHA) will begin enforcement of its Emergency Temporary Standard (ETS) on vaccine mandates in early 2022 barring an emergency stay from the Supreme Court of the United States (SCOTUS). MCAA’s Safety Bulletin on the ETS, the MCAA Model COVID-19 Mandatory-Vaccination Policy, and NEW MCAA Model COVID-19 Vaccination, Testing and Face Covering Policy outline what needs to be done to be compliant with the ETS.

It is important for all MCAA members to begin making every possible attempt to comply with the standard, and carefully document every part of every attempt made to comply.

MCAA offers three items, available via the buttons below, that may be useful to you:

“To account for any uncertainty created by the stay, OSHA is exercising enforcement discretion with respect to the compliance dates of the ETS. To provide employers with sufficient time to come into compliance, OSHA will not issue citations for noncompliance with any requirements of the ETS before January 10 and will not issue citations for noncompliance with the standard’s testing requirements before February 9, so long as an employer is exercising reasonable, good faith efforts to come into compliance with the standard. OSHA will work closely with the regulated community to provide compliance assistance.”

VDC Webinar Mini-Series: Explore ITM Content Solutions for Autodesk Software

Utilizing Autodesk’s BIM software for fabrication like CADmep, CAMduct and ESTmep, can provide your company with significant productivity improvements, accuracy and coordination gains. To operate with fabrication level precision, it takes precise ITM content that doesn’t come with the software out of the box. Contractors need to create their own catalog of ITM components or work with third-party providers to purchase ITM-managed databases.

In this third and final installment of MCAA’s VDC Webinar Mini-Series, U.S. Engineering’s Director of Virtual Construction, Ryan Frazier, talks about how the company has approached both options and chose to use Trimble Managed Content. U.S. Engineering’s case study examines factors in their decision like cost, manpower, productivity and software integration. Ryan is joined by Seth Greenlund, Product Manager at Trimble, responsible for Trimble Managed Content.

Ryan Frazier – Ryan Frazier is the Director of Virtual Construction for U.S. Engineering and has been in the BIM industry for 17 years. Ryan has held various roles from detailing to management and has primarily focused on the MEP trades. Seth Greenlund – Seth has been in the MEP industry since 2002. He started as a detailer using Autodesk Building Systems and in 2005 moved to Fabrication CADmep, ESTmep and CAMduct. He moved over to the software side of MEP in 2012 and has worked as a trainer, support manager, content group manager.

Congratulations to 2021’s Newest IPM Graduates

MCAA is thrilled to congratulate the newest graduates of the Institute for Project Management! In September, MCAA member companies from across the country sent us their best and brightest – many of whom had waited for 18 months while we negotiated travel bans and safety concerns before resuming programming. Last week, they completed the second week of their 85-hour course and became the first IPM grads since January of 2020.

These PMs brought both energy and enthusiasm to the classroom and beyond as they engaged with their instructors and each other to create a learning community and a network that we are confident that will far outlast their time in the program. As participants left Austin with certificates of completion and a bunch of new friends, it was hard to say who was happier – the students, or our team of dedicated volunteer contractor-instructors, who are working double-time this fall to catch up with the pandemic-driven backlog.

Now in its 34th year, the Institute for Project Management is intended to take top-notch PMs with 3+ years of experience and make them even better at what they do. For more information about the program click the link below.

ETS NEWS 12/17/21 – 6th Circuit Dissolved the Stay of the OSHA ETS, Emergency Stay Application Filed, New Compliance Deadlines

A three-judge panel of the 6th Circuit Court of Appeals dissolved the stay of the Occupational Safety & Health Administration (OSHA) Emergency Temporary Standard (ETS) on vaccine mandates and testing on December 17, 2021. An emergency stay application has since been filed with the Supreme Court of the United States (SCOTUS) and OSHA has announced new compliance deadlines for implementation and enforcement of the ETS.

6th Circuit Dissolved Stay on OSHA ETS

The court order does not mention deadline extensions, it simply grants “the Government’s motion and DISSOLVE[S] the stay issued by the Fifth Circuit.”  MCAA has filed a request with OSHA to extend enforcement deadlines so all employers can have time to develop the appropriate plans.

OSHA Announces New Compliance Deadlines

January 10, 2022: all requirements except testing

February 9, 2022: testing

OSHA “will not issue citations for noncompliance with the standard’s testing requirements before February 9, so long as an employer is exercising reasonable, good faith efforts to come into compliance with the standard.”

OSHA released the following statement:
